How much time do you get in Texas for aggravated assault? ALONG with Endangerment to a Child?
It is first offense in this type of charge but pt has a history of warrants for unpaid traffic tickets, wrap sheet of traffic tickets, charges of DUI, fled once from the cops, history of drug use (not on his record) and is a current drug user/addict, not that it matters but thats just fyi,
Anyhow person was involved in a road rage incident and got charged with aggravated assault and endangerment to a child. Because he had a 9 year old in the passenger seat while firing a 9 mm at the other car involved in the road rage. HOW MUCH TIME CAN HE EXPECT TO GET??
and Can he be bailed out or saved yet again by his family who endlessly enables his drug addiction?
Aggravated Assault is a second degree felony (in this case).
Endangering a Child is a state jail felony.
The judge can sentence him to whatever he wants, as long as it is no more than the law allows. He may even plea to lesser charges. The max he can receive is 2 to 20 years and a fine no more than $10,000 for the Agg Assault.
The state jail felony will be treated as a third degree felony because of the weapon, 2 to 10 years and a fine no more than $10,000. The judge can give him probation to 30 years (serving each separately). He will see some time for it, how much is anyones guess.
