Government jobs and FBI background checks?
About 4 years ago I got a DWI on an AF base, I wanted to fight the charge in court as the charge was pretty ridiculous, but my commander advised me to take the charge, article 15, and he would expunge my record, which he did, two months later. I had a background investigation at my last job which went off without a hitch, but I have recently been offered a position with the local VA hospital. I know this background check is much more in depth as it is an FBI fingerprint check. My question is, am I automatically disqualified from this job over having an article 15 on my record? There was no spot for me to disclose military convictions on the application but I also know that it is better to be truthful upfront than to have to explain something later. I have already been offered the position and I did the fingerprinting today so I am not sure if I should keep looking or if I should just take a breather and relax.
You are not automatically disqualified for an Article 15.
Also, keep in mind that an Article 15 ISN’T a conviction. It is non-judicial punishment. A conviction can only arise out of a judicial proceding.
You can have an article 15 in your history and still get a security clearance, so you don’t have anything to worry about. If they don’t ask for any non-judicial punishment, don’t offer it. If they ask, then be truthful.
