Whether you’re talking to your own insurance company or that of the other driver, your conversation is more than likely to be recorded. So when you’re asked about your drinking, witnesses, and whether or not you’re intoxicated, you need to know that these statements can be used against you in your criminal case. Meeting with a lawyer will help you answer the correct questions and limit any potential criminal liability. Watch the video now to learn more. href="http://www.austin-dwi.info/defense-attorney-2">Defense Attorney Stephen Hamilton, practicing in Lubbock, Texas, talks about getting your hospital records and how they can be used against you in your DWI case. Your hospital records can come in as evidence in your case. So we need to make sure we contact the hospital first and try to stop this action. Hospital blood tests are very different from field blood tests in a DWI case and cause you harm in your case. They are not as reliable as other test because they are looking for whether or not there is alcohol in your system, not for an amount that could be illegal. Your blood alcohol concentration level is critical in your case and you need someone who has dealt with this issue many times. Watch the video now to learn more. href="http://www.austin-dwi.info/defense-attorney-2">Defense Attorney Stephen Hamilton, practicing in Lubbock, Texas, explains the steps on how to contest blood results. Contesting a blood test in your DWI case usually falls into 3 categories. Can we show that the person who took the blood did so incorrectly? Can we show that the sample tube of your blood was prepared correctly? Blood is tested in preservatives and chemicals, and they must be in the correct balance to show you were intoxicated. Lastly, we look at the actual lab were the blood is processed. Do they have continued problems in their testing? We look at all these areas and more to help contest your blood test and get the possible outcome for your DWI case. Watch the video now to learn more. The first thirty days of any DWI case is the most critical. Many things can change and need to be recorded now, while memories are still fresh and changes have not been made. Like the area in which you took the field sobriety tests needs to be recorded before construction changes are made or before the next season rolls in. Also, witnesses need to be located. Such as waiters, waitresses, and bartenders who are not likely to remember who you are and what you had to drink six months down the road. Many pieces of evidence and reports need to be gathered quickly to help defend your case. Watch the video now to learn more. For more information about hiring a Defense Attorney Stephen Hamilton, practicing in Lubbock, Texas, discusses what HGN (horizontal gaze nystagmus) is and how it’s looked for in a field sobriety test. HGN, or horizontal gaze nystagmus, is an involuntary jerking of the eye. An officer will use a pencil, or what they call a stimulus pen. And they’ll put it in front of your face, at a certain length, and they’ll begin to move it in certain directions. And what the officer is looking for is a twitch — a bounce. This is a clue that you’re intoxicated. However, officers only receive twenty-four hours of training in this area, yet they state in court your arrest is based on their expertise. There are many types of nystagmus and the officer doesn’t know them. So, that’s one of the areas of big concerns we have in regards to a test you’ve taken, that is given by someone not an expert in this area. Watch the video now to learn more.
