HGN, or horizontal gaze nystagmus, is an involuntary jerking of the eye. An officer will use a pencil, or what they call a stimulus pen. And they’ll put it in front of your face, at a certain length, and they’ll begin to move it in certain directions. And what the officer is looking for is a twitch — a bounce. This is a clue that you’re intoxicated. However, officers only receive twenty-four hours of training in this area, yet they state in court your arrest is based on their expertise. There are many types of nystagmus and the officer doesn’t know them.
