Texas does not have alimony in the sense you probably think of. That is, Texas does not simply force the ex-husband to give money to the ex-wife after a divorce. Instead, Texas has something called “spousal maintenance.” However, the requirements can be onerous, and even if you qualify, the benefit is limited.
To receive spousal maintenance in Texas, you must have been married for at least 10 years, unless you are disabled or have a serious health problem making you unable to work. Spousal maintenance is capped at $2,500 a month for a maximum time period of three years. This is the maximum amount of money and time that can be awarded; you are not guaranteed this amount. Spousal maintenance can be reduced or eliminated if the person receiving maintenance gets even a minimum-wage paying job.
If you think you quality for spousal maintenance, you need to speak to your lawyer immediately.
