Has anyone in TX ever modified a Preference of Child 12yrs & older affidavit to include visitation?

Our teenage child no longer wants to visit their non-custodial parent in TX. We have a Preference affidavit on file with the courts for residence that insures the child living with us, but we’ve heard of modifying the affidavit to include visitation. Our TX attorney has never done one, but would like to look into having our child sign one as extra “inusrance” to go along with major supporting evidence for reducing if not ceasing visitation with the non-custodial parent. He needs to view a precident however to determine the best way to do this. Would anyone who has done this please respond with which county you did this in & perhaps the attorney so our attorney can contact them? Our county is Montgomery. Thank you.

First of all, a LOT (most of it) depends on the age of the child.

MANY custodial parents “poison pill” the non-custodial by constantly talking bad about them in front of, or to, the child. The result is that many children express the desire to stop visitation (hoping to please the abusive parent). A custodial parent in this situation has NO RIGHT to EVER be around the child again. NONE. This is the WORST type of child abuse and really should be a felony offense.

The court will certainly want to know WHY the child is expressing the desire to cut it off.
